General terms and conditions

This site is owned and operated by Love Candy Floss  Registered Address 7 Wingfield Close, Maulden, Bedfordshire, MK45 2FW.  If you want to ask us anything about these terms and conditions or have any comments or complaints on or about our website, please contact us.

Ownership of rights

All rights, including copyright, in this website are owned by Love Candy Floss (referred to as We, Our, Us). You may not modify, distribute or re-post anything on this website for any purpose.  Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without the permission of Love Candy Floss. To request permission to use any contents please contact us.

Accuracy of content

Love Candy Floss has taken every care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at time of publishing and all products have been fairly described. However, orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website. Prices quoted are not subject to VAT at this time. Packaging may vary from that shown. The weights, dimensions and capacities given are approximate only.  We have made every effort to display as accurately as possible the colours of our products that appear on the website. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the product on delivery.

Availability

All items are subject to availability. We will inform you as soon as possible if the goods you have ordered are not available by emailing you.

Delivery charges

Delivery charges vary depending on the type of products ordered Freshly prepared items such as Candy Floss and Toffee Apples are sent next day by courier.  In the UK, delivery charge refunds can only be made in accordance with your legal rights under the Distance Selling Regulations and other legislation.  Similar rights may apply for some international deliveries.

Collecting your order

We are happy for you to collect your order from us where this is preffered, if this is the case please contact us to arrange a time to collect your order from us.  Non collections of perishable goods will not be refunded.

Acknowledgment and acceptance of your order

If you have supplied us with your email address, we will notify you by email as soon as possible to confirm receipt of your order. Our acceptance of your order will take place upon despatch of the product(s) ordered.

Delays

Occasionally, your order may be delayed, this is usually due to imported items being delayed by customs.  If there is any delay with your order you will be notified by email and advised of its progress.

Cancellation right

Under the Distance Selling Regulations, UK consumers have the legal right to cancel their order within seven working days of receipt of the goods (with the exception of made to order items such as Candy Floss, Popcorn, Toffee Apples and any other items as permitted under local law where applicable).  Where goods are delivered to a third party you will only be able to exercise this right if you are able to return to us the goods you ordered. For details of how to exercise this right please see our Returns and Refunds section.

Substitution

 In the event of supply difficulties, we reserve the right to substitute goods or packaging of equal quality and value. We will reimburse you for the cost of returning substitute goods that you do not wish to accept.

We have placed links on this website to other websites we think you may want to visit. We do not vet these websites and do not have any control over their contents. Love Candy Floss cannot accept any liability in respect of the use of these websites.

Changes to legal notices

We reserve the right to change these terms & conditions from time to time and you should look through them as often as possible.

This website, any content contained herein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English Law. The parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.

Cancellations, Amendments & Returns

As soon as you realise that you need to change your order please contact us on 01525 840847 or email us info@lovecandyfloss.com and one of our advisors will help you. If you amend your order, you may find there are changes to your delivery timescale and/or the price you pay for the item (as you’ll be charged the current selling price on the day you amend the order).  Once you have taken delivery of your order, you have a legal right to cancel your order within 7 days. The packaging may be opened but the goods should not be used.  (We do not accept returns of Persihable goods) Items should be in a resaleable condition and returned or collection arrangements made promptly at your cost.  If collection of an item is required, we will charge you the cost of collection (up to £100) of which you will be notified at time of cancellation.

Payment

All payments processed are processed by Sage Pay.  Payments made to Love Candy Floss via the website form part of a contract, by paying Love Candy Floss you are agreeing to Purchase the selected items from us under these Terms and Conditions.

Delivery Arrangements

Small items under 1kg in weight are delivered by 1st Class royal mail.

larger items are delivered by our courier service.
Short dated items ( Toffee Apples, Candy Floss) are delivered by next day courier.

We make every effort to dispatch your item within 48 hours of receiving your order, unless otherwise advised.  If you have requested a particular delivery date, your order will be despatched accordingly to arrive as requested.

Deliveries are booked in good time and we can not be held responsible for third party delays, although we will do our best to help resolve the issue.
 
Delays

Occasionally, delivery of your order may be delayed or postponed.  We will, or course, make every effort to keep you informed and discuss revised delivery timescales.


Terms and Conditions Of Event Booking

Inevitably, we have a few terms and conditions that you should read through before booking the services of Love Candy Floss for your event.  We’ve kept them simple and divided them according to the length of time between making your booking and the date of event itself.

Events booked more than 3 months in advance

1.    A deposit of 25% must be received in cleared funds (this can take the form of a cheque with the guarantee number written on the reverse, or a direct electronic transfer via BACS, PayPal or any credit or debit card) in order to secure your booking.
2.    The outstanding balance is to be paid no less than 7 working days prior to your event.
3.    In the unfortunate event of you having to cancel the booking:
(i)    more than 30 days in advance, we will retain 10% of the overall cost of the event and refund the difference of the deposit to you;
(ii)    less than 30 days in advance, we will retain the deposit in full.

Events booked less than 3 months in advance

1.    A deposit of 50% must be received in cleared funds (this can take the form of a cheque with the guarantee number written on the reverse, or a direct electronic transfer via BACS, PayPal or any credit or debit card) in order to secure your booking.
2.    The outstanding balance is to be paid no less than 7 working days prior to your event.
3.    In the unfortunate event of you having to cancel the booking:
(i)    more than 30 days in advance, we will retain 25% of the overall cost of the event and refund the difference of the deposit to you;
(ii)    less than 30 days in advance, we will retain the deposit in full.

Events booked less than 2 weeks in advance

1.    Full payment must be received in cleared funds (this can take the form of a cheque with the guarantee number written on the reverse, or a direct electronic transfer via BACS, PayPal or any credit or debit card) in order to secure your booking.
2.    In the unfortunate event of you having to cancel the booking, we will reimburse 50% of your payment to you.

Event re-scheduling policy

In the event that you have to cancel the booking and immediately ask that the date be re-scheduled, we promise to do our best to accommodate your request but this may prove difficult at peak times of the year.  If we are able to amend the booking date then we will not impose any further administration charges.  If, however, your request cannot be accommodated then the relevant cancellation clause will apply (see above).

Booking forms

Whether your booking form is in paper or electronic format, by completing the form you are deemed to have read and understood our terms and conditions of trade and that you agree to comply with them.  

Deposits

All deposits must be received within 3 working days of the receipt of the booking form by Love Candy Floss.  In the event that the deposit is not received within this period, we will make your chosen time and date available to other customers.
